Spain Returns Law: What Online Sellers Must Know
Spain is a large, price-sensitive ecommerce market with an unusual enforcement geometry: consumer protection is applied by seventeen autonomous communities alongside national law. For a merchant that means the substantive rules are national and familiar, but the body that writes to you when a shopper complains may be regional, and regional authorities differ in how quickly and how formally they escalate.
The practical implication is not that you need seventeen policies. It is that your documentation has to be good enough to satisfy whichever authority picks up the file, because you do not get to choose.
The Withdrawal Right in Spanish Law
Spain implements the EU right of withdrawal through its consumer protection legislation, giving the consumer fourteen calendar days to withdraw from a distance contract without giving a reason. The consolidated texts are published in the Spanish official gazette, the Boletín Oficial del Estado.
The counting rules follow the EU pattern: the period runs from the day after delivery for goods, and from contract conclusion for services. Where an order is delivered in several parcels, the clock starts with the last one. Failure to inform the consumer of the right extends the window by twelve months, and Spanish authorities treat inadequate pre-contract information as a distinct infringement rather than a technicality.
Pre-Contract Information Is the Enforcement Surface
Most Spanish enforcement action against distance sellers concerns information duties rather than refusal to accept returns. The obligations are specific: identity and address of the trader, total price including taxes and delivery, the existence and conditions of the withdrawal right, the model withdrawal form, and who bears return costs. Each of these must be given in a clear and comprehensible manner before the consumer is bound.
Language matters here in a way it does not everywhere. A Spanish-facing storefront whose returns terms are only available in English is exposed, because the information has not been provided comprehensibly to the consumer. Merchants already running a multilingual returns portal usually have the infrastructure; the gap is normally in the terms page rather than the flow.
| Obligation | Spanish position | Common merchant gap |
|---|---|---|
| Withdrawal period | 14 calendar days from delivery | Counting from order date |
| Information failure | Extends period by 12 months | Terms in English only |
| Model withdrawal form | Must be supplied | Portal offered but no form |
| Return cost disclosure | Required before contract | Buried in FAQ, not in terms |
| Refund deadline | 14 days from withdrawal | Waiting for grading to finish |
| Refund method | Same means of payment | Defaulting to store credit |
Refunds: Deadline, Method and Withholding
You must reimburse all payments received, including the original delivery cost up to the cheapest standard option, within fourteen days of being informed of the withdrawal. As elsewhere in the EU, you may withhold reimbursement until you receive the goods or proof of dispatch, whichever is earlier.
The method obligation is stricter in practice than merchants expect: reimbursement must use the same means of payment the consumer used, unless the consumer expressly agrees otherwise and incurs no cost as a result. Offering store credit as the default option, or making it the path of least resistance in your portal, is where otherwise compliant merchants create exposure. Our comparison of store credit versus refund covers how to present the choice without steering it.
Value Reduction and Condition Disputes
Spanish law allows a deduction where the consumer has handled the goods beyond what is necessary to establish their nature, characteristics and functioning. Disputes concentrate on what "beyond necessary" means for clothing and footwear, and the burden of showing diminished value sits with the merchant. Evidence discipline matters more than policy wording: dated photographs at receipt, a consistent grading standard, and a written rationale. Teams with a defined return grading and disposition process are far better placed than those grading by feel.
Regional Authorities and Consumer Arbitration
Alongside national rules, each autonomous community operates its own consumer authority, and many disputes route into the consumer arbitration system rather than the courts. Participation is voluntary for the trader unless you have adhered to the arbitration scheme, but adherence is often displayed as a trust signal and can be commercially useful in a market where shoppers check for it.
- Publish returns terms in Spanish, not only in English.
- Provide the model withdrawal form as a downloadable document, not just a portal button.
- State return shipping responsibility in the terms page itself, not only in help content.
- Refund to the original payment method by default; make store credit an explicit opt-in.
- Keep dated evidence for any value-reduction deduction.
- Decide deliberately whether to adhere to the consumer arbitration scheme.
In Spain the returns case you lose is rarely the one about the product. It is the one where you cannot show what the shopper was told before paying.
Operational Notes for Cross-Border Sellers
Spain has strong parcel networks and high drop-off density in urban areas, which makes network-based returns economically attractive relative to home collection. If your Spanish volume is meaningful, comparing carrier drop-off against courier pickup is usually worth the modelling exercise, as covered in drop-off versus home pickup.
The Canary Islands, Ceuta and Melilla sit outside the EU customs and VAT territory, which changes the paperwork and the economics of a return shipped from there. Merchants often discover this only when a return from Tenerife generates unexpected charges. Treat those destinations as their own lane in your policy and your rate card, and read them alongside customs duties on international returns.
Finally, expect seasonality. Spanish sales periods and the extended gifting season around Reyes shift return peaks later than in northern Europe, which matters if your capacity planning assumes a single January spike. The holiday returns peak season playbook is a reasonable starting point to adapt.
How long do Spanish consumers have to return an online order?
Fourteen calendar days from the day after they receive the goods, without needing to give a reason. If the order arrives in multiple parcels the period starts with the final delivery. If the trader did not properly inform the consumer of the withdrawal right before the purchase, the period extends by twelve months.
Do my returns terms need to be in Spanish?
Pre-contract information must be provided in a clear and comprehensible manner to the consumer. For a storefront actively selling to Spanish consumers, terms available only in English are hard to defend as comprehensible, and information failures are a distinct infringement rather than a technicality. Translating the terms page is a low-cost way to close that exposure.
Can I refund as store credit in Spain?
Only if the consumer expressly agrees and incurs no cost from it. The default obligation is to reimburse using the same means of payment the consumer used. Presenting store credit as the easiest or pre-selected option in your returns portal is the pattern that creates risk, even when a refund is technically available elsewhere in the flow.
Are the Canary Islands treated the same as mainland Spain?
Not for customs and VAT purposes. The Canary Islands, Ceuta and Melilla sit outside the EU customs and VAT territory, so returns shipped from those regions involve different paperwork and cost. The consumer law position is Spanish, but the logistics and tax treatment differ enough that most merchants handle them as a separate lane.
